Privacy Policy

KushOps LLC (“KushOps,” “we,” “us”) provides analytics and operations software to licensed cannabis retailers. This policy explains what information we collect, how we use it, and the choices available to you.

Who this policy covers

KushOps serves two groups of people, and the distinction matters:

• Our customers — licensed cannabis businesses and their staff, who hold accounts and use the KushOps platform directly.
• Our customers’ customers — dispensary patrons and patients whose transaction data flows into KushOps from a retailer’s point-of-sale system.

For the second group, KushOps acts as a service provider to the retailer. The retailer determines what data is collected and why; we process it on their instructions. If you are a dispensary customer and want your data corrected or deleted, contact the dispensary you purchased from — they control it, and we will support their request.

Information we collect

From account holders: name, business email address, phone number, employer, role and permissions, and authentication metadata. We use a third-party identity provider for sign-in and do not store passwords.

From connected point-of-sale systems: transaction records, product and inventory data, and customer records including name, contact details, purchase history, and — where the retailer operates a medical program — patient identifiers and date of birth. This data is ingested under the retailer’s authorization using API credentials they provide.

Automatically: IP address, browser and device type, pages viewed, and timestamps, used to operate and secure the service.

How we use information

To provide, maintain and secure the platform; to generate the analytics and reports our customers request; to send service and account notifications; to detect fraud and abuse; and to comply with legal obligations. We do not sell personal information, and we do not use our customers’ data to build advertising profiles.

Mobile information and text messaging

KushOps and the retailers who use our platform may send text messages to individuals who have opted in to receive them.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile information of the end user opting in to a messaging program will never be shared or sold to third parties.

Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for assistance. Opting out of text messages does not affect any other service. Our full messaging terms are in the Terms of Service.

How we share information

We share personal information only with: service providers who help us operate the platform (hosting, error monitoring, email and SMS delivery, identity), each bound by contract to use it solely to provide those services; the retailer whose data it is; and where required by law or to protect rights and safety. If KushOps is involved in a merger or acquisition, information may transfer as a business asset, subject to this policy.

Mobile opt-in and consent data is excluded from every category above and is never shared.

Data retention and security

We retain customer data for as long as the account is active and as needed for legal and operational requirements. Access is restricted by role and by location within each account. Data is encrypted in transit and at rest, and API credentials are stored encrypted per tenant.

Your choices

Account holders may access, correct, or delete their information through account settings or by contacting us. Depending on where you live, you may have additional rights over your personal information; contact us and we will respond as required by applicable law. Dispensary customers should direct requests to the retailer they transacted with.

Children

The KushOps platform serves an age-restricted industry and is not directed to anyone under 21. We do not knowingly collect information from anyone under 21.

Changes

We will post any changes to this policy on this page and update the date above. Material changes will be communicated to account holders directly.
